Family Photography Booking Terms & Conditions

These terms form the agreement between Tom Handbury Photography, operated by Tom Handbury as a sole trader of 10 Bromley Road, Bingley, BD16 4BU (“Tom”), and the person making the booking (“the Client”). They apply to Full Family Experiences, Simple Family Sessions and related products.

1. Booking and contract

A booking is confirmed only when the required payment and acceptance of these terms have been received. The person booking confirms that they are at least 18 and have authority to make practical arrangements for everyone taking part.

Any important accessibility, health or safeguarding information that may reasonably affect the session should be discussed in advance. Tom will handle such information discreetly and use it only to plan and provide the service.

2. The Full Family Experience

A booking payment reserves the agreed date and includes preparation, personal guidance, the photography session and a viewing appointment.

The session usually lasts around 1½ hours and is for up to ten people unless otherwise agreed.

Travel to a location within 25 miles of Bingley is included. Additional travel or venue fees must be agreed before booking.

No finished photographs are included in the £95 booking payment.

3. Choosing photographs after a Full Family Experience

At the viewing appointment, the Client may choose how to keep their photographs, including a complete digital gallery, an album or a boxed, mounted fine-art print collection. There is no obligation to purchase digital photographs. Digital photographs are available only as a complete gallery, rather than smaller collections.

The booking payment and product prices are set out in the price guide supplied before booking. Those prices will apply to the session’s viewing appointment and initial order, unless a different arrangement is expressly agreed in writing.

If the complete digital gallery is purchased, the booking payment already paid is credited towards its total price. The remaining balance is payable before the digital files are released.

Digital photographs and physical products may be combined. The full order price, including any applicable taxes and delivery charges, will be confirmed in writing before the Client places an order. Bespoke products will be quoted according to the chosen size, materials and design.

Once a bespoke album or mounted print collection has been approved and sent to production, it cannot normally be changed or cancelled unless faulty or not as described. Statutory rights are unaffected.

4. Simple Family Sessions

The session price is confirmed in writing before booking and is payable in full before the session.

Sessions are offered on selected weekdays, at specified local locations, for one immediate family of up to six people unless otherwise stated.

Photography lasts up to 45 minutes.

Tom selects and individually edits 15 photographs. The Client does not select from a larger proof gallery.

The selected photographs are supplied as high-resolution digital downloads through a private online gallery.

A preparation guide is included. A planning call and viewing appointment are not included.

5. Cooling-off period

Where the contract is made online or by telephone, the Client normally has 14 days from the day after the contract is made to cancel. If the Client asks Tom to begin planning or provide the session during that period, the Client expressly requests early performance. If the service is partly performed before cancellation, Tom may retain or charge a proportionate amount for work already completed. The right to cancel ends once the service has been fully performed with the Client’s prior agreement and acknowledgement.

Bespoke goods and digital content have specific cancellation rules. Where digital delivery is requested within the cancellation period, Tom will obtain any additional express consent and acknowledgement required before supply.

6. Client cancellation and rescheduling

Full Family Experience: the Client may transfer the booking once with at least 14 days’ notice, subject to availability. Where the Client requests a change to a weekend booking, an alternative weekend date cannot be guaranteed; replacement dates may be limited to Monday to Friday. Genuine illness or emergency will be handled reasonably, taking individual circumstances into account. The Client should give as much notice as possible.

Simple Family Session: because these sessions are tied to limited dates and locations, a transfer is not guaranteed. Where at least 7 days’ notice is given, Tom will try to offer one alternative Simple Session date within six months, subject to availability.

If the Client cancels outside the statutory cooling-off period, any amount retained will reflect work already carried out and losses that cannot reasonably be avoided, including the reserved date where it cannot be resold. Tom will take reasonable steps to reduce any loss.

7. Weather, illness and cancellation by Tom

Tom will decide whether weather or light makes an outdoor session unsuitable, in consultation with the Client where practical. Cloud, wind or a light shower will not automatically require postponement. If conditions are genuinely unsuitable, the session will be rearranged without an additional booking payment.

If Tom cannot provide the session because of illness, emergency or circumstances outside reasonable control, an alternative date will be offered. If no reasonable alternative can be agreed, payments for services not provided will be refunded. Tom will not appoint a replacement photographer without the Client’s agreement.

8. Attendance and conduct

The Client should arrive on time and ensure participants are appropriately supervised. Children remain the responsibility of their parent or accompanying adult. Tom may pause or end a session if continuing would be unsafe, unlawful or seriously abusive. The fee will not be refunded where the service cannot reasonably be completed because of the Client’s conduct.

9. Artistic approach and image selection

The Client has reviewed Tom’s portfolio and understands that lighting, weather, location, personalities and circumstances affect the result. Tom controls composition, capture, culling and editing and supplies only photographs meeting his professional standard. RAW, unedited and rejected files are not supplied. Minor retouching is included; extensive alteration may be declined or quoted separately.

Tom cannot guarantee a particular expression, pose, grouping or minimum number of usable photographs from a Full Family Experience, but will use reasonable care and skill to create a varied gallery.

10. Delivery and gallery access

Viewing galleries are normally ready within four weeks unless another timescale is agreed. Purchased digital files are released after cleared payment. Online galleries remain available for the stated gallery period; Clients should download and back up purchased files promptly.

Albums and boxed mounted print collections are normally supplied within 6 weeks after final approval and payment. Delays caused by specialist makers, carriers or circumstances outside reasonable control will be communicated promptly.

11. Products, colour and faults

Screens and home printers vary, so exact colour matching cannot be guaranteed outside the professional production process. Products should be checked promptly. Faulty, damaged or misdescribed products should be reported within a reasonable time, with photographs where helpful. Nothing in these terms limits statutory rights.

12. Copyright and personal use

Copyright remains with Tom Handbury Photography. Purchased digital files include a licence for personal printing and non-commercial sharing. They must not be sold, entered into commercial campaigns, materially edited, filtered or used by another business without written permission. Cropping by a social platform is permitted.

13. Portfolio and marketing permission

Booking does not give Tom permission to publish identifiable photographs. Website, portfolio, competition, social-media or other marketing use requires a separate optional permission. Refusing or withdrawing marketing consent does not affect the photography service. Withdrawal applies to future use and may not remove material already lawfully printed or published beyond Tom’s reasonable control.

14. Image retention

Image files are normally retained for up to 12 months after gallery delivery, but long-term storage is not guaranteed. Clients are responsible for backing up purchased digital files. Contract, order and financial records may be retained for longer where required by law or reasonably necessary for legal purposes.

15. Liability

Tom will provide the service with reasonable care and skill. Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud, or the Client’s statutory rights. Subject to that, Tom is not responsible for losses that were not reasonably foreseeable when the contract was made or for business losses arising from a consumer booking.

16. Complaints and law

Concerns should be raised promptly with Tom at info@tomhandbury.co.uk or 07523 538658 so that they can be addressed. These terms are governed by the law of England and Wales. Consumers retain any right to bring proceedings in another UK jurisdiction where applicable.
