Booking Terms & Conditions

These Terms apply to all:
• Portrait sessions (family, newborn, and branding)
• Framed artwork, albums, and digital image collections
• Digital downloads and online guides
• Gift vouchers

16. Updates to These Terms

These Terms & Conditions help ensure a smooth and enjoyable session for you and your family.

1. Introduction

3.1 A £100 booking fee is required to secure your session date. The session is not confirmed until this payment is received.
3.2 The booking fee is generally non-refundable, as it covers time spent preparing for your session and reserves your date.
3.3 However, if you book online or by phone, UK law provides a 14-day cooling-off period during which you may cancel for a full refund - unless you have requested that the session or preparatory work begin within that period. Once this work begins, the booking fee becomes non-refundable.
3.4 The remaining balance for your session and digital downloads must be paid in full on or before the session date. The remaining balance for your products and any additional digital downloads will be due as agreed - typically following your design consultation, before production of any artwork or digital images. Any products or digital downloads will only be delivered once payment has been received in full.
3.5 Accepted payment methods include bank transfer, card payment, or other methods agreed in advance.

2. Services Covered

These Booking Terms & Conditions form the agreement between you (the “Client”) and Tom Handbury Photography, owned and operated by Tom Handbury, sole trader, of 10 Bromley Road, Bingley, BD16 4BU.
By booking a session, purchasing a product, or ordering a gift voucher, you agree to be bound by these Terms & Conditions.
These terms do not affect your statutory rights as a consumer.

3. Booking & Payment

These Terms may be updated occasionally to reflect legal or business changes. The version in place at the time of booking applies to your contract.

4. Rescheduling & Cancellation

4.1 You may reschedule your session once, provided you give at least 14 days’ notice.
4.2 In an emergency, you may reschedule once with at least 3 hours’ notice.
4.3 If rescheduling is not possible, or if the required notice is not given, the booking will be considered cancelled and no refund will be issued.
4.4 If Tom Handbury Photography must cancel due to illness, emergency, or circumstances beyond control (e.g. extreme weather or road closures), you will be offered a new date or a refund of any payments made, minus any preparatory work already completed.
4.5 In rare circumstances where Tom Handbury cannot attend, a trusted replacement photographer may be offered, or your session will be refunded.

5. The Session

5.1 Sessions are carried out with reasonable care and skill, in a relaxed and creative manner reflecting Tom’s artistic style.
5.2 The Client is responsible for arriving on time, ensuring all participants are ready, and obtaining permission to use any chosen locations.
5.3 Tom reserves the right to adjust timing or location if required by weather or light conditions.

6. Delivery of Images & Artwork

6.1 Digital image proofs or galleries are typically delivered within 4 weeks of your session.
6.2 Framed artwork and albums are handmade and may take 4–8 weeks after final design approval.
6.3 You will be invited to a design consultation to choose your final products.
6.4 Framed products and albums are usually hand-delivered within 40 miles of Bingley; beyond this distance, delivery or collection will be arranged.
6.5 Once products have been delivered or collected, they become your responsibility. Please inspect them promptly and notify Tom Handbury Photography of any issues within 7 days.

7. Cooling-Off & Cancellation Rights

7.1 If you book online or by phone, you have a 14-day cooling-off period from the date of booking.
7.2 If you ask for your session or preparatory work to begin within this period, you acknowledge that your right to cancel will end once the work begins.
7.3 Bespoke or customised products (such as framed pieces or albums) are non-refundable once production has started, in line with UK consumer law.
7.4 This does not affect your statutory rights regarding faulty or misdescribed goods.

8. Image Editing & Artistic Style

8.1 All images are edited in Tom Handbury’s signature natural and timeless style.
8.2 Minor retouching is included; extensive retouching requests may incur an additional charge.
8.3 RAW or unedited image files are never provided.
8.4 Creative decisions (lighting, composition, editing style) remain at the photographer’s discretion.

9. Copyright & Usage Rights

9.1 All images remain the copyright and intellectual property of Tom Handbury Photography.
9.2 Clients are granted a personal-use licence to print and share their images for personal, non-commercial purposes only.
9.3 Images must not be edited, sold, or used for commercial purposes without written permission.
9.4 Tom Handbury Photography will always request written consent before using any images for the website, portfolio, or marketing.
9.5 If consent is given, images may be used indefinitely in print and digital materials.

10. Gift Vouchers

10.1 Gift vouchers are valid for 12 months from the date of purchase.
10.2 Vouchers are refundable within 14 days of purchase if unused.
10.3 After 14 days, vouchers are non-refundable but may be transferred to another person with written permission from Tom Handbury Photography.
10.4 Vouchers hold no cash value and may only be redeemed against sessions or products.

11. Prices & Promotions

11.1 All prices are in GBP (£) and include all applicable taxes (Tom Handbury Photography is not VAT-registered).
11.2 Prices may change at any time, but confirmed bookings are not affected.
11.3 Promotional pricing errors may be corrected, and the price shown at checkout will always be the correct one.

12. Liability

12.1 Tom Handbury Photography will perform all services with reasonable care and skill.
12.2 Liability for any loss or damage arising from services or products is limited to the amount paid by the Client for that session or order.
12.3 Nothing in these Terms limits liability for death or personal injury caused by negligence.

13. Data Protection & Privacy

13.1 Personal data is collected and processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
13.2 Information is used solely to provide services, process orders, and communicate with you.
13.3 Client images and personal information are stored securely for up to 12 months, after which digital files may be deleted unless otherwise agreed.

15. Governing Law & Jurisdiction

15.1 These Terms are governed by the laws of England and Wales.
15.2 Any disputes will be subject to the exclusive jurisdiction of the English courts.
