School Photograph Parent Ordering Terms

Schools receive a separate photography agreement and terms before confirming their booking.
These terms apply when a parent, carer or other customer purchases school photographs directly from Tom Handbury Photography, operated by Tom Handbury as a sole trader of 10 Bromley Road, Bingley, BD16 4BU (“Tom”). The School is not the seller of these products unless expressly stated.
1. Gallery access and privacy
The gallery is private and intended only for authorised families. Access links, QR cards, passwords and pupil codes must not be posted publicly or shared beyond those entitled to view the relevant photographs. Suspected unauthorised access should be reported immediately to info@tomhandbury.co.uk.
Customers must not download, copy, screenshot, publish or distribute preview images. Preview images may be watermarked or displayed at reduced resolution.
2. Orders and payment
Product descriptions, prices, delivery choices and any order deadline are shown in the gallery. An order is accepted when payment has been authorised and an order confirmation is issued. The customer is responsible for checking names, products, sizes, quantities and delivery details before submitting the order.
If an obvious pricing or technical error is discovered before fulfilment, Tom will contact the customer and offer the correct purchase or a refund.
3. Products
Available products may include single prints, print packs, and digital downloads for individual or sibling portraits. Class and group photographs are supplied as prints only unless the gallery expressly states otherwise.
Print dimensions are approximate and minor cropping may be required to fit the chosen format. Screens vary and cannot reproduce printed colour exactly.
4. Digital downloads
A purchased digital file is licensed for the customer’s personal, non-commercial use, including personal printing and private or personal social sharing. Copyright remains with Tom Handbury Photography. Files must not be resold, commercially published, materially edited, filtered or used to train an artificial-intelligence system.
Where a download is supplied during a statutory cancellation period, the customer will be asked expressly to consent to immediate supply and acknowledge that the right to cancel the digital purchase is lost once supply begins, while statutory rights for faulty or misdescribed content remain.
5. Delivery
Orders are delivered by the method selected at checkout. Where bulk delivery to School is offered, orders may be held until the published closing date and delivered together. The School may distribute sealed orders but is not responsible for production or customer service.
Estimated dispatch or delivery dates are not guaranteed. Tom will communicate a significant delay. Customers should contact Tom if an order has not arrived within a reasonable period after the stated estimate.
6. Cancellation and returns
Consumer cancellation rights depend on the product and how it is supplied. Standard goods bought online can normally be cancelled within 14 days after delivery, but exceptions may apply to personalised or bespoke products. Digital-download cancellation rights may end once supply begins with the customer’s express agreement and acknowledgement.
To request cancellation, email info@tomhandbury.co.uk with the order number. Where a return right applies, products must be kept in reasonable condition and returned as instructed. This clause does not affect rights where goods or digital content are faulty, damaged or not as described.
7. Faults and corrections
Please report a damaged, faulty, missing or incorrect order promptly, including the order number and a photograph where helpful. Tom will investigate and provide the remedy required by consumer law, which may include replacement, repair or refund. A change of mind about a correctly supplied personalised product does not create a right to a refund where a lawful exception applies.
8. Image selection and retouching
Tom selects and edits the images offered for sale. RAW and unedited files are not supplied. Minor retouching and colour correction are carried out at professional discretion. Specific expressions, poses or combinations cannot be guaranteed.
9. Gallery availability and retention
The gallery remains open for the published period. Late ordering may not be possible or may involve different delivery charges. Purchased digital files should be downloaded and backed up promptly. Image and pupil-identification data are retained only for the period described in the Privacy Policy and the arrangement with the School; permanent archiving is not guaranteed.
10. Marketing use
A purchase does not give permission for a child’s photograph to be used in Tom’s advertising, portfolio or social media. Any such use requires separate, optional permission managed through the appropriate school or parent process.
11. Liability and statutory rights
Tom supplies goods and digital content with reasonable care and skill. Nothing in these terms excludes rights or liability that cannot legally be excluded. Tom is not responsible for losses caused by inaccurate customer information, public sharing of private access details or use outside the personal licence.
12. Privacy, complaints and contact
Personal information is handled under the Tom Handbury Photography Privacy Policy. These terms are governed by the law of England and Wales, subject to any consumer right to bring proceedings elsewhere in the UK.
